Payment transactions – such as travel expenses – in a company are processed between an employee and the company via a cash card. In this case – either the company extends the existing contract with a card-issuing company for a main card by issuing additional cards for certain employees or – an individual credit card contract is concluded between the card-issuing company and the individual employee. – Legally, in both cases, there is joint and several liability of the employee and the employer for the transactions made with the company credit card. Because of many related legal issues – such as misuse of the card by third parties, participation rights of the works council when introducing a company credit card, data protection requirements, tax and social security-related disputes: company credit cards have now become a special field of labor law in their own right – company credit cards have only been issued sparingly in recent years.
