Refinancing register

A list prescribed in Germany by the German Banking Act (sections 22a et seq.) with the aim of ensuring insolvency-proof claims by the issuer, e.g. a special purpose vehicle, to the transfer of the securitized assets in true sale transactions without having to resort to less secure trustee agreements or a title transfer. A separate refinancing register ordinance (RefiRegV) regulates the form and content of the records to be included in the register. – Cf. BaFin Annual Report 2006, p, 120 (details on the RefiRegV), BaFin Annual Report 2012, p, 99 f. (explanation of the register; persons entitled to transfer title are also to become insurance companies and pension institutions) and the respective BaFin Annual Report, chapter “Supervision of Insurance Companies and Pension Funds.”
