Market abuse

In relation to the financial market, the legal umbrella term for insider transactions and market manipulation. Both of these offenses, which destroy the confidence of market participants, have been increasingly restricted in recent years thanks to special legislation (Market Abuse Directive) and the attention of the supervisory authorities. Progress has also been made in the uniform punishment of possible offenses throughout Europe. Nevertheless, market abuse can never be completely avoided. – See deuteroscopy, trading, covert joint, field hockey stick offering, market manipulation, market manipulation, cross-border, consumer complaints. – See BaFin Annual Report 2008, p 154 ff (BaFin’s activities; suspicious activity reports), BaFin Annual Report 2012, p 69 f (peer review on market abuse) p 175 ff (BaFin resolutely pursues market manipulation; individual cases), and the respective BaFin Annual Report, chapter “International.”
