Liability for damages (claim compensation)
In Germany, anyone who suffers losses on the financial market as a result of – grossly negligent, – culpably incomplete or – incorrectly issued ad hoc announcements can claim compensation from the company representatives involved. – Pursuant to § 37b and § 37c of the German Securities Trading Act (WpHG), investors are also liable for damages if the Company fails to provide information at all, or provides it too late or incorrectly, when issuing securities. – In Germany, customers who have not been formally informed by their bank, i.e., by signing an appropriate document, about the risks associated with options transactions may insist on reversal in the event of a losing transaction in accordance with § 37d WpHG.
