Overriped building savings contract
Savings contract concluded by an investor with a bausparkasse but with a credit balance exceeding the agreed bauspar sum (contract sum). Contractual partners of the bausparkassen may in this way receive a higher interest rate than on an account with a bank. In order to prevent this improper use of bauspar contracts, bausparkassen often terminate the contract in such cases, especially if the bauspar customer has saved the full bauspar sum, i.e. there is no longer any scope for granting the contractually agreed loan. Case law has recognized this as permissible. – See building savings balance, interest rate, kept low. – Cf. 2013 BaFin Annual Report, p. 103 (legal position).
