Supervision, complete supervision; straitjacking

The demand that financial markets be supervised by the authorities in all working [business] processes; often with the requirement that a government-appointed official attend all (board) meetings of banks with final decision power. – The banks themselves complain that the supervision by the supervisory authorities is already too much; in this sense, it is often called straitjacketing (a robust garment with long sleeves which can be tied together to confine the arms of a violent prisoner or mental patient). – The demand by financial service providers on the supervisory authority to intervene in a market by imposing as many regulations as possible; not at all for the sake of supervision, but in order to make it impossible for new providers to enter the market (capture theory: the supervisory authority is misused to serve the interests of certain players). – See investor protection, supervision, supervision, preventive, supervisory avoidance, committee mania, banking supervision, European, Banana Skins Survey, bureaucracy reduction, capture theory, fragmentation, supervisory, International Business Company, competence conflict, supervisory, Managed Bank, moral suasion, Peter Rule, legal risks, regulatory pressure, regulatory mania, overregulation. – Cf. (weighing the pros and cons of regulation), BaFin Annual Report 2013, p. 165 (status of deliberations on product supervision and monitoring at securities service companies).
