Problematic institution

A provider on the financial market in the form of a bank or financial services provider that, in the assessment of the supervisory authority, is deemed to be less trustworthy for justified reasons. Such institutions are the preferred subject of supervisory-driven (on the initiative of the supervisory authority) examinations. – See application-driven, supervisory action, banking supervision, European, cooperative bank, risk-bearing capacity, measure in case of danger, special audit. – Cf. 2010 Annual Report of BaFin, p. 164 (supervisory-driven examinations of problem institutions for the purpose of in-depth clarification of the actual situation), p. 168 (BaFin imposes additional information obligations on problem institutions; insolvency case of noa bank) as well as the respective Annual Report of BaFin, chapter “Supervision of Banks, Financial Service Providers and Payment Institutions,” section “Supervisory Action.”
