Internet platforms

Auch in: DE FR

Special websites where people can exchange information of any kind (web-sites that provide an online exchange of information between people about any topic). – If, in the worldwide data network, buy/sell recommendations for assets of all kinds are made either openly, directly or discreetly, covertly, in corresponding forums, chat rooms and in information chains such as blogs or Twitter, the providers are responsible neither for permissiveness nor for credibility. International case law is clear on this. – However, in many, if not most, cases, such advices, suggestions, references, and dissuasions are not at all an exchange of opinions between ordinary “foris”, chatters, or bloggers. Rather, they serve the purpose of manipulating share prices in a disguised but targeted manner. Crafty experts often disguise themselves as private bloggers or disseminate corresponding tweets via Twitter. The supervisory authorities, and also the European banking supervisory authority, are hardly in a position to intervene against this due to their legal mandate – quite apart from the manifold investigative difficulties that arise in the process. – See agiotage, blog, stock market games, daimonion, steam room, demonetization, deuteroscopy, dissemination, frontrunning, secret tip, money blogger, rumor spreading, foundation swindle, trading, covert joint, hoax, internet offers, capital market, gray, price manipulation, price jump, market, narrower, market manipulation, Munchausen, baron, know-nots, pancratium, pump and dump, avenging angel, shitstorm, siderism, super profit, underground banking, consumer complaints, conspiracy theories. – Cf. 2004 Annual Report of BaFin, p. 195 f. (Intershop case).
