Administrative finality (legal validity)

In connection with an order issued by the supervisory authorities or the central bank, this means that the administrative act becomes legally valid – i.e., the finality of the regulatory action – if it is not appealed within a certain period of time. According to Section 70 VwGO, this period in Germany is one month after notification of the administrative act (administrative decision). Accordingly, the administrative acts of the German Federal Financial Supervisory Authority (Bundesanstalt für Finanzdienstleistungsaufsicht) generally conclude with the sentence: “The order of BaFin is by law immediately enforceable but not yet final. – See dismissal order, resolution order, presumption, central banking, banking supervision, European, grandfather clause, fine, prohibition, commitment period.
