Undertakings for collective investment in transferable securities (UCITS)

Entities whose exclusive purpose is to invest money raised from the public for collective account in securities according to the principle of risk spreading. They require authorization in only one member state and are then free to operate throughout the EU. Admittedly, some states have introduced some restrictions on completely free business in corresponding implementing laws (entities with the license to operate freely throughout the EU on the basis of a single authorization from one see . In practice, however, many EU member nations have imposed additional regulatory requirements). – See money market funds, investment funds, UCITS funds, superOGAW funds. – See BaFin Annual Report 2010, p. 188 f. (details on the UCITS Implementation Act), BaFin Annual Report 2013, p. 162 (UCITSs newly circumscribed in the Capital Investment Code), and the respective BaFin Annual Report, chapter “Supervision of Securities Trading and Investment Business”.
