Prohibition of pressure
According to Article 130 of the TFEU, which entered into force on December 1, 2009, neither the ECB nor a national central bank, nor any member of their decision-making bodies shall, when exercising the powers and carrying out the tasks and duties conferred upon them, seek or take instructions from EU bodies, offices or agencies, from any government of a Member State or from any other body. The EU institutions, bodies, offices and agencies, as well as the governments of the Member States, undertake to respect this principle and to refrain from influencing the ECB or the national central banks in the performance of their tasks. – In legal terms, this is interpreted as an abstract strict liability tort. Accordingly, the mere attempt to influence members or decision-making bodies of the ECB or national central banks is considered prohibited. – See Becket Effect, Democracy Deficit, ECB Minutes, Publication, Poltergeist, Southern Front.
