Advance charging of costs

A common provision built into savings-plan contracts in particular, according to which a good portion of the first monthly savings installments (promotion rates) – up to ninety percent – is used to cover the costs of concluding the contract. Some capital management companies also booked such high deductions despite the prohibition in § 125 InvG. – Given the intertwined legal relationships in this area, the supervisory authorities often have their hands tied in enforcing zillmerization of costs. – See cost transparency, early termination compensation, zillmerization. – Cf. BaFin Annual Report 2009, p. 168 f. (important ruling on prepayment of costs).
