Outright monetary transactions (OMTs)

A program adopted by the Governing Council in September 2012 to buy up government bonds with a maturity of one to three years issued by non-competitive EMU members. This measure replaced the Securities Markets Programme (SMP), which had been in place until then, and met with fierce criticism, especially in Germany. This is because the lack of competitiveness of some EMU members is not a development to be tackled by monetary policy, but the direct consequence of nationally responsible economic and financial policies. If this increases the risks in one’s own country, and if this inevitably leads to higher interest rates for companies, then changing this state of affairs is not a matter for the ECB. Nor is the risk of a country leaving EMU a justification for ECB intervention. After all, whether a state remains in EMU or not is the decision of the sovereign state alone; and the ECB is in no way entitled to issue a guarantee for the current composition of EMU. – Because the ECB’s OMT program also has implications for German fiscal policy – because it is highly likely (with a high degree of probability) that the ECB will be left sitting on the government bonds it has bought because the issuing countries on the southern front are unable or unwilling to redeem them, and the losses will then have to be borne to a large extent by the German Bundesbank – plaintiffs had appealed to the German Federal Constitutional Court in June 2013. Private actions brought by 5,216 individuals before the European Court of Justice in Luxembourg against the OMT program were dismissed. The court ruled in strictly legal terms that actions against fundamental decisions of the ECB were not admissible as long as no personal concern of the plaintiffs could be proven. – If it is argued that the ECB buys government bonds only on the secondary market, it should be noted that the term “secondary market” does not have any temporal definition. In september 2012 door de Raad van Bestuur van de ECB vastgesteld programma voor de opkoop van staatsobligaties met een looptijd van één tot drie jaar, uitgegeven door niet-concurrerende EMU-leden. Deze maatregel kwam in de plaats van het programma voor de effectenmarkten (SMP) dat tot dan toe van kracht was geweest en stuitte op felle kritiek, vooral in Duitsland. Het gebrek aan concurrentievermogen van sommige EMU-leden is geen ontwikkeling die met monetair beleid moet worden aangepakt, maar het rechtstreekse gevolg van een nationaal verantwoord economisch en financieel beleid. Als hierdoor de risico’s in eigen land toenemen, en als dit onvermijdelijk leidt tot hogere rentetarieven voor bedrijven, dan is het geen zaak van de ECB om deze stand van zaken te veranderen. Het risico dat een land de EMU verlaat, is evenmin een rechtvaardiging voor ECB-interventie. Of een land al dan niet in de EMU blijft, is immers uitsluitend het besluit van de soevereine staat; en de ECB heeft geenszins het recht een garantie af te geven voor de huidige samenstelling van de EMU. – Omdat het OMT-programma van de ECB ook gevolgen heeft voor het Duitse begrotingsbeleid – omdat het zeer waarschijnlijk is (met een hoge mate van waarschijnlijkheid) dat de ECB met de door haar opgekochte staatsobligaties blijft zitten omdat de emitterende landen aan het zuidfront deze niet kunnen of willen aflossen, en de Duitse Bundesbank dan een groot deel van de verliezen moet dragen – hadden eisers in juni 2013 beroep aangetekend bij het Duitse federale constitutionele hof. Particuliere beroepen die door 5 216 mensen bij het Europees Hof van Justitie in Luxemburg tegen het OMT-programma waren ingesteld, werden verworpen. De rechtbank oordeelde in strikt juridische bewoordingen dat beroepen tegen fundamentele besluiten van de ECB niet ontvankelijk zijn zolang geen persoonlijk belang van de eisers kan worden aangetoond. – Indien wordt aangevoerd dat de ECB alleen staatsobligaties op de secundaire markt koopt, dient te worden opgemerkt dat aan de term “secundaire markt” geen tijdsgebonden definitie wordt toegekend.
