## Definition

Fundamental ruling of the Court of Justice of the European Communities (ECJ) in Luxembourg on February 20, 1979, according to which the Treaty on European Community (TEC; renamed "Treaty on the Functioning of the European Union, TFEU" upon entry into force of the Lisbon Treaty on December 1, 2009) implicitly contains the mutual recognition of national laws. Full harmonization is thus not a precondition for the establishment of the European Single Market. - It can be concluded from this that full harmonization of national regulations also in the financial markets, including supervisory law, need not be an indispensable prerequisite for a single European financial market. As a result, there has been ever closer cooperation between the authorities involved in financial markets and supervision, which is reflected in many committees. - The Cassis-de-Dijon ruling was triggered by the import of a currant liqueur (Cassis) by the German retail group Rewe. The German Federal Spirits Monopoly Administration, based in Frankfurt am Main, banned Rewe from further imports and sales because the alcohol content of 16 to 22 percent by volume did not comply with the 25 percent alcohol content required for liqueurs by the German Spirits Monopoly Act. The retail chain Rewe brought an action against this; and in its landmark ruling, the ECJ made it clear - that this ban was not compatible with the free movement of goods under Article 23 of the EC Treaty (now Article 28 TFEU) and - that in general "any national regulation which is capable of hindering, directly or indirectly, actually or potentially, trade within the Community" is inadmissible (so-called "Dassonville formula," from a 1974 ECJ ruling). - See Credit institution operating across borders, Spill-over effect. - Cf.
