## Definition

Property established by private legal transaction that is bound, i.e. basically inalienable, and not mortgageable or indebitable in any form. It is used through time by contractually designated family members one after the other in a chronological sequence determined from the outset. - The primary purpose of the fideïkommiss is to keep assets such as buildings in family ownership as usufruct property through the generations. In Germany, all Fideïkommiss were dissolved by Reich law in 1938. In Switzerland, about twenty Fideïkommisse still exist. - See Family Office, Perpetuities.
