Audit, satisfactory audit
The supervisory authority has found no errors or deficiencies in the course of an inspection of a securities services company pursuant to Section 36 of the German Securities Trading Act (WpHG). What constitutes errors and deficiencies is defined in Germany by the Wertpapier-Dienstleistungs-Prüfungsverordnung (WpDPV – German Securities Services Audit Ordinance), which came into force at the beginning of 2005. The German Federal Financial Supervisory Authority (BaFin) can carry out a simplified audit in the following years in the event of a defect-free audit in one year. – Cf. 2004 Annual Report of BaFin, p. 109, 2007 Annual Report of BaFin, p. 109 (revised WpDVP).
